Services and Pricing

We offer both free and paid subscription plans:

Free Accounts:
Free Accounts provide access to basic features of our Services, including a limited number of scans per month.

Paid Accounts (Subscriptions):
Paid Accounts offer enhanced features and higher usage limits. By upgrading to a Paid Account, you gain access to additional scans and other premium features.

Billing and Payment

Subscription Fees:
When you subscribe to a Paid Account, you authorize us to charge your chosen payment method the applicable fees at the frequency specified (e.g., monthly or annually).

Auto-Renewal:
Paid Accounts automatically renew at the end of each billing cycle unless canceled prior to the renewal date.

Taxes:
All fees are exclusive of taxes, which may be added as required by law.

Cancellation and Refunds

Cancellation:
You may cancel your Paid Account at any time through your account settings. Cancellation will take effect at the end of the current billing period.

No Refunds:
Except as required by law, subscription fees are non-refundable. Upon cancellation, you will retain access to premium features until the end of your current billing cycle.

Downgrades:
If payment is not received on time, we reserve the right to downgrade your account to a Free Account, which may result in loss of access to certain features and data.

Usage Limits and Fair Use

Usage Limits:
All accounts are subject to usage limits. We may enforce these limits to ensure optimal performance for all users.

Fair Use Policy:
Excessive use of the Services that adversely affects system performance or other users is prohibited. We reserve the right to take appropriate action, including suspension or termination of your account, if we determine that your usage violates this policy.

Changes to Fees
We may modify the fees for our Services from time to time. We will provide you with reasonable advance notice of any fee changes by email or through the Services. Your continued use of the Paid Account after the fee change becomes effective constitutes your agreement to pay the modified fees.

Termination
You may stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services with notice if you violate these Terms or if your actions risk harm to other users or the integrity of the Services. In cases of serious breaches, we may terminate your access immediately without prior notice.

Discontinuation of Services
We may decide to discontinue the Services in response to unforeseen circumstances beyond our control or to comply with legal requirements. If we do, we will provide you with reasonable prior notice so that you can export Your Content. If we discontinue Services before the end of any paid term, we will refund the portion of the fees you have pre-paid but have not received Services for.

We provide the Services "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be secure or available at any particular time or location.

Limitation of Liability
To the fullest extent permitted by law, in no event will StorageIQ, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of the Services. Our total liability for any claims under these Terms is limited to the amount you paid us in the 12 months preceding the claim.

Arbitration Clause
Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration administered by a recognized arbitration institution. The arbitration will be conducted in English, and the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Benton County, Arkansas, and you hereby consent to the personal jurisdiction and venue therein.

Changes to Terms
We may update these Terms from time to time. If we make significant changes, we will provide you with at least 30 days' notice via email or through the Services before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.

In the event of a data breach that affects Your Content or personal information, we will notify you without undue delay after becoming aware of the breach. We will provide information about the nature of the breach, the data affected, and the steps we are taking to address it.
